Law Enforcement & Data Requests Policy
Describes how FitSwap responds to government and law enforcement requests for user data, consistent with the Privacy Policyand Alberta's PIPA.
18.1 Valid Legal Process Required
FitSwap discloses user data to law enforcement or government bodies only in response to valid legal process enforceable in Canada — such as a court order, warrant, or production order — or with the affected user's consent, or as otherwise permitted under PIPA (for example, to comply with a subpoena, warrant, or court order, or in connection with the investigation of an offence, per PIPA §20). FitSwap reviews every request for legal sufficiency and will narrow or push back on requests that are overly broad, vague, or don't appear properly issued.
18.2 Emergency Requests
Where FitSwap has a good-faith belief that a request involves an imminent risk of death or serious bodily harm, it may disclose limited information necessary to address that risk without first receiving formal legal process. Emergency requests are still reviewed for genuine urgency before any disclosure.
18.3 User Notification
FitSwap notifies an affected user before or promptly after disclosing their information, unless doing so is prohibited by law (for example, a court-ordered non-disclosure requirement), or would create a genuine risk to an active investigation or to someone's safety — in which case notice is given once that restriction no longer applies, where possible.
18.4 Preservation Requests
FitSwap may preserve specific account records for a limited period at a law enforcement agency's request while that agency obtains the legal process required to actually compel disclosure. A preservation request alone does not result in any data being handed over.
18.5 International Requests
Requests from law enforcement outside Canada are handled through the applicable mutual legal assistance treaty (MLAT) process or equivalent formal international channel, rather than direct compliance, unless Canadian law otherwise requires a different response.
18.6 Data Retention in Connection With Requests
Outside of an active preservation request under §18.4, data subject to a law enforcement request is otherwise retained according to the schedule in the Privacy Policy§14.7 — a request does not, on its own, extend how long FitSwap keeps information beyond what's needed to respond to it.
18.7 Transparency Reporting
FitSwap does not currently publish a periodic transparency report disclosing the volume and type of requests received.
